Art. 1 – Definitions
For the purposes of these General Charter Terms and Conditions, the following definitions apply:
“Shipowner” or “Ninfio Yacht Charter”: the company providing vessels for the yacht charter service, with operational headquarters in Campania, Italy.
“Client” or “Charterer”: the natural or legal person who makes the booking and/or uses the charter service.
“Vessel” or “Yacht”: the watercraft made available for the charter service, including the professional crew.
“Booking”: the confirmed request for chartering a vessel for a specific date and itinerary.
“Day Cruise”: the charter service lasting a single day, with standard hours from 10:00 AM to 6:00 PM.
“Custom Itinerary”: the customised charter service in terms of duration and route, subject to a dedicated quote.
Art. 2 – Subject of the Contract
These Terms and Conditions govern the contractual relationship between Ninfio Yacht Charter and the Client for the crewed yacht charter service. The service is provided in the navigation areas agreed upon between the parties from time to time, based on availability and operational conditions.
The service includes the provision of the selected vessel, complete with qualified professional crew (captain and, where applicable, deckhand), for the agreed duration and itinerary.
Art. 3 – Booking and Confirmation
3.1 Booking methods
Bookings can be made through the website www.ninfioyachtcharter.com, by email, or by phone. Online bookings for day cruises require direct payment through accepted payment systems (credit card, Stripe). For charters exceeding one day, the Client will receive a customised quote.
3.2 Booking confirmation
The booking is considered confirmed only upon receipt of the deposit payment or full payment (for day cruises) and the sending of written confirmation by Ninfio Yacht Charter. The Shipowner reserves the right to contact the Client after booking to verify the actual availability of the selected vessel.
3.3 Required personal data
At the time of booking, the Client is required to provide: first name, surname, email address, and phone number. Data will be processed in accordance with applicable personal data protection regulations (GDPR – EU Regulation 2016/679).
Art. 4 – Prices and Payment
4.1 Price determination
Prices shown on the website are expressed in Euros (EUR) and refer to the crewed vessel charter for the indicated duration. Prices may vary based on seasonality:
Low season: November – March
Mid season: April – May and September – October
High season: June – August
4.2 What the price includes
The charter price includes, unless otherwise stated:
Use of the vessel for the agreed duration
Professional crew (captain and deckhand where applicable)
Vessel insurance and third-party liability
Safety equipment as required by law
Basic snorkelling equipment (where available)
4.3 What the price does NOT include
The charter price does NOT include and shall be borne by the Client:
Fuel: the cost of fuel is variable and will be communicated to the Client separately after booking confirmation. Actual consumption depends on the itinerary and sea-weather conditions. In any case, this cost must be paid in advance of the selected cruise start date, unless otherwise agreed with the Shipowner
Port and mooring taxes, where applicable
Entrance tickets to the Blue Grotto or other attractions
Meals, beverages, and catering (except as expressly included in the chosen package)
Extra services and Luxury Service, unless expressly indicated
4.4 Payment methods
The following payment methods are accepted: credit and debit cards (Visa, Mastercard, American Express) via Stripe, bank transfer, and cash. Payment by bank transfer or cash is also accepted for day cruises, provided it is made before the cruise start date. For multi-day charters, a deposit of 30% of the total is required at the time of booking, with the balance due no later than 7 days before departure.
Art. 5 – Cancellation and Refunds
5.1 Cancellation by the Client
The Client may cancel the booking under the following conditions:
Cancellation more than 7 days before the departure date: full refund of the amount paid, net of handling fees (5%)
Cancellation between 3 and 7 days before: refund of 50% of the amount paid
Cancellation within 48 hours of departure: no refund
Cancellation must be communicated in writing by email. The date of receipt of the communication shall prevail.
5.2 Cancellation by the Shipowner
Ninfio Yacht Charter reserves the right to cancel the booking due to force majeure, adverse sea-weather conditions rendering navigation unsafe, or unavailability of the vessel for technical reasons. In such cases, the Client shall be entitled to: an alternative date agreed upon by mutual consent, or a full refund of the amount paid, without further penalties.
5.3 Date modification
The Client may request a change of charter date, at no additional cost, with at least 5 business daysβ notice, subject to vessel availability.
Art. 6 – Weather Conditions and Safety
The safety of passengers and crew is the absolute priority. The Captain has full authority and discretion to decide:
The feasibility of setting sail based on sea-weather conditions
Any modifications to the planned itinerary to ensure safety
Early return to port in the event of worsening conditions
The Captainβs decisions regarding safety are final and do not entitle the Client to any refund, except in the case of non-departure, for which Art. 5.2 shall apply.
In the event of adverse weather conditions confirmed before departure, Ninfio Yacht Charter will contact the Client at least 2 hours before the scheduled boarding time to agree on an alternative solution.
Art. 7 – Client Obligations and Responsibilities
The Client undertakes to:
a) Arrive at the boarding point at the agreed time. Delays exceeding 30 minutes may result in a reduction of the charter duration without any refund
b) Follow the crewβs instructions regarding safety and conduct on board
c) Not exceed the maximum number of passengers declared and permitted for the vessel
d) Maintain proper and respectful behaviour towards the vessel and its equipment
e) Communicate in advance any health conditions, allergies, or physical limitations that may affect safety on board
f) Not bring on board illegal substances, weapons, or dangerous materials
The Client is liable for any damage caused to the vessel, its equipment, and fittings through wilful misconduct or negligence by the Client or their guests. The Shipowner reserves the right to claim compensation for verified damages.
Art. 8 – Shipowner Liability
Ninfio Yacht Charter guarantees that all vessels comply with safety and seaworthiness certifications required by current Italian law. The Shipowner is responsible for the routine and extraordinary maintenance of vessels and the professional qualifications of the crew.
The Shipowner shall not be liable for: delays, itinerary changes, or cancellations due to sea-weather conditions, orders from maritime or port authorities, force majeure; loss or damage to the Clientβs personal belongings left on board; any discomfort arising from wave motion, seasickness, or ordinary sea conditions.
Art. 9 – Insurance
All vessels in the Ninfio Yacht Charter fleet are covered by third-party liability insurance as required by law. Insurance coverage does not include passengersβ personal belongings. The Client is advised to take out their own travel insurance covering cancellations, luggage, and personal injuries.
Art. 10 – Additional Services and Luxury Service
Ninfio Yacht Charter offers additional services and Luxury Service packages that may be requested at the time of booking or subsequently, subject to availability. The types and details of available additional services will be communicated upon the Clientβs request.
The costs of additional services will be communicated separately and must be settled before departure.
Art. 11 – Minors and Passengers with Special Needs
Minors must always be accompanied by a responsible adult. The Shipowner provides life jackets of all sizes, including childrenβs sizes. Any special needs (reduced mobility, food allergies for catering, etc.) must be communicated at the time of booking to allow for proper service organisation.
Art. 12 – Complaints
Any complaints regarding the service must be submitted in writing by email within 14 days of the charter date. Ninfio Yacht Charter undertakes to respond within 30 days of receiving the complaint. Complaints submitted after the indicated deadline may not be considered.
Art. 13 – Personal Data Protection
Personal data provided by the Client is processed by Ninfio Yacht Charter as Data Controller, in accordance with European Regulation 2016/679 (GDPR) and Italian Legislative Decree 196/2003 as amended. Data is collected and processed exclusively for purposes related to the execution of the charter service, administrative and accounting management, and the sending of commercial communications with the Clientβs explicit consent.

Art. 14 – Right of Withdrawal
Pursuant to the Italian Consumer Code (Legislative Decree 206/2005), the consumer Client who makes an online booking has the right to withdraw from the contract within 7 days of booking confirmation, without penalty and without specifying a reason, by communicating their decision in writing by email. The right of withdrawal does not apply if the service has already been fully performed or if departure is scheduled within the 7 days following the booking, with the Clientβs express consent.
Art. 15 – Force Majeure
Neither party shall be held liable for non-performance due to force majeure, meaning: adverse sea-weather conditions rendering navigation unsafe or inadvisable, exceptional natural events (storms, tsunamis, volcanic eruptions), epidemics or pandemics, public authority measures, strikes, wars or acts of terrorism, and any other unforeseeable and unavoidable event making the performance of the service impossible.
Art. 16 – Applicable Law and Jurisdiction
These Terms and Conditions are governed by Italian law. For any dispute arising from the interpretation or execution of this contract, the Court of Naples shall have exclusive jurisdiction, without prejudice to the mandatory consumer forum pursuant to Art. 33 of the Italian Consumer Code.
Art. 17 – Final Provisions
The possible invalidity or ineffectiveness of one or more clauses of these Terms and Conditions shall not affect the validity of the remaining provisions, which shall remain fully effective. Ninfio Yacht Charter reserves the right to amend these Terms and Conditions at any time. Amendments shall take effect from the date of publication on the website and shall apply to bookings made after that date.
By making a booking, the Client declares to have read, understood, and fully accepted these General Charter Terms and Conditions.
